These Terms and Conditions ("Terms") govern your use of the tracking hardware, software platform, and related services (collectively, the "Service") provided by Mastercom Limited ("we," "us," or "our"). By subscribing to, accessing, or using the Service, you agree to be bound by these Terms.
The Service involves the provision and installation of a GPS tracking device ("Device") in your vehicle ("Vehicle"). You acknowledge that the installation is performed by certified technicians and unauthorized removal or tampering with the Device will void the warranty and may result in a service termination fee.
The Service provides real-time location data, speed, status reports, and history ("Tracking Data") of the Vehicle. You acknowledge that Tracking Data accuracy is subject to the limitations of GPS, cellular network coverage, and atmospheric conditions. We do not guarantee uninterrupted availability of the Tracking Data.
The Service is intended for the legal tracking of vehicles that you own or have explicit authorization to monitor. You are solely responsible for compliance with all local, state, and national laws regarding vehicle monitoring, data privacy, and surveillance. We reserve the right to immediately suspend service if illegal or unethical use is suspected.
Failure to pay any Subscription Fee within 14 days of the due date will result in the temporary suspension of the Service. We reserve the right to terminate the account and remotely disable the Device if payment remains overdue for 30 days.
You may cancel your subscription at any time by providing 30 days' written notice. Cancellation may be subject to a final fee if the cancellation occurs before the minimum contract term (if applicable).
We may terminate or suspend the Service immediately without prior notice if you breach these Terms, misuse the Service, or if we are unable to continue providing the Service due to technical or legal reasons.
We provide a limited warranty of 1 year on the Device, covering manufacturing defects. This warranty does not cover:
You acknowledge that the Service is primarily a tracking and management tool. While it aids in theft recovery, we are not an insurer of your vehicle or its contents.
We are committed to protecting your privacy. Our collection and use of personal and Tracking Data are governed by our separate Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the data practices described in that policy.
These Terms shall be governed by and construed in accordance with the laws of The Government of Kenya. Any dispute arising from these Terms shall be resolved through binding arbitration in Kenya, or, if agreed upon, in a court of competent jurisdiction in Kenya.
